CONSTITUTION OF THE DEMOCRACY OF THE FREE CONSTITUENCY OF SEAVIEW To guarantee that no Right nor Freedom nor Liberty of any Citizen of the Democracy of the Free Constituency of Seaview shall not be infringed upon by any State, Government, State-operated organisation, or otherwise Governmental organisation or agency, We the People of the Democracy of the Free Constituency of Seaview, henceforth referred to by her full name as well as "the Democracy of Seaview" and "Seaview," hereby establish this Constitution. Article ISection 1. Certain rights are completely inalienable by any Organisation or Person, Public or Private. Section 2. The aforementioned rights are the Right to Freedom of Speech and Thought, Right to Freedom of the Press, Right to practice Religion, Right from forced practice of Religion, Right to a fair Trial by Jury of his or her Peers, Right to living, Freedom to own Property, and Right to practice all of these Rights without persecution or prosecution from any Organisation or Person, Public or Private. Article IISection 1. The Democracy of the Free Constituency of Seaview shall have her legislative Powers vested directly in all Citizens. Section 2. Laws may be proposed by the Applicant Mayor of the Democracy of the Free Constituency of Seaview, the Easterly Mayor of the Democracy of the Free Constituency of Seaview, the Westerly Mayor of the Democracy of the Free Constituency of Seaview, or an amount of Citizens of the Democracy of the Free Constituency of Seaview limited only to a minimum amount of 1. Section 3. The position of Applicant Mayor is not an Elected Position. It is a position that may be handed down, whether or not for monetary benefit of the original Applicant Mayor, solely at the Applicant Mayor's discretion. Section 4. The positions of Easterly and Westerly Mayors are also not Elected Positions. They are positions that may be handed down, whether or not for monetary benefit of the Easterly or Westerly Mayor, solely at the discretion of the respective Mayor, Easterly or Westerly, with approval of the Applicant Mayor. The Position may also be relinquished and relinquishment of Easterly or Westerly Mayor is irreversible. Article IIISection 1. Laws may be written by any of those qualified under Article 2 §1. Laws may be submitted at any time. The protocol for the submission of Laws falls under the Law Submission Protocol of the Democracy of Seaview. Section 2. In order for a law to be enacted, the Law must obtain a favourable Vote of more than exactly one-half of Citizens, excluding those who qualify for exemption from eviction due to offline status under EAM15004§2. Section 3. A law may be repealed at any time by a Vote of the Citizens of the Democracy of Seaview. Section 4. Amendments to this Constitution may be proposed at any time and are exempt from the protocol listed under the Law Submission Protocol of the Democracy of Seaview. Amendments that add to this Constitution without removing or altering any Text of this Constitution, henceforth known as an Additive Amendment, must obtain a two-thirds majority Vote of all Citizens, including those who qualify for exemption from eviction due to offline status under EAM15004§2. Amendments that remove or alter any Text of this Constitution up to one section long, henceforth known as a Sectional Amendment, must obtain a three-quarters majority Vote of all Citizens of the Democracy of Seaview, including those who qualify for exemption from eviction due to offline status under EAM15004§2. Amendments that remove or alter any Text of this Constitution with a length longer than one section as well as amendments that remove or alter any Text of this specific section, henceforth known as a Superlative Amendment, must receive a unanimous Vote of all Citizens of the Democracy of Seaview, including those who qualify for exemption from eviction due to offline status under EAM15004§2. Section 5. The Applicant Mayor, the Easterly Mayor, and the Westerly Mayor may all Vote on Laws and Additive Amendments. Section 6. The Applicant Mayor is barred from Voting on Sectional Amendments. The Easterly Mayor and the Westerly Mayor may vote on Sectional Amendments. Section 7. Barred from Voting on Superlative Amendments are the Applicant Mayor, the Easterly Mayor, the Westerly Mayor, anyone who has been warned or banned for grieving, anyone who has received a Banishment from the Democracy of Seaview but has successfully appealed to have his or her Banishment lifted, non-Citizens of the Democracy of the Free Constituency of Seaview, any Citizen who has received a temporary Banishment from the Server of EcoCityCraft with the exemption of any Citizen who have requested to have themselves temporary Banished, and any Citizen who has received a permanent Banishment from the Server of EcoCityCraft but has successfully appealed against their Banishment, with the exemption of any Citizen who has had their Superlative Amendment Voting Rights restored by a Jury of his or her Peers. Section 8. A Citizen of the Democracy of the Free Constituency of Seaview is defined as "any human being who owns Property within the Boundaries of the Democracy of Seaview, with the exemption of items borrowed by or rented by a Citizen, and who is not currently subjected to a Banishment from the Democracy of the Free Constituency of Seaview only issued by the Applicant Mayor of Seaview, and who is not currently a Citizen of any Town, State, Nation, or other organisation granted Member Status of the United Nations of EcoCityCraft, and who is not currently an Ambassador to the United Nations of EcoCityCraft." Section 9. No Law may be Enacted nor Voted upon if it is found to be in violation of the Constitution of the Democracy of Seaview prior to the Vote or Enactment. Article IVSection 1. The Westerly Mayor is to be the presiding Judge over all Cases and Trials. Section 2. The presiding Judge is to have no more Authority over any Case or Trial than to officially declare the Commencement and Conclusion of the Case or Trial. The Conclusion must be officially declared immediately following the Statement from the Jury. If no Statement is provided by the Jury, the Conclusion must be officially declared immediately following the Reading of the Verdict. Section 3. Eligible for Trial are only Citizens of the Democracy of the Free Constituency of Seaview, those who have received a Banishment from the Democracy of Seaview only issued by the Applicant Mayor, and the Constitutionality of Laws. Section 4. If a Trial or Case's Verdict is announced by the Jury, the Verdict is final and may only be Appealed with the approval by a unanimous Vote of the Easterly Mayor, Westerly Mayor, and Applicant Mayor. Section 5. Veto powers are vested in both the Citizens of the Democracy of Seaview and the Jury of any Trial challenging the Constitutionality of any Law. Section 6. Should a Jury of a Trial challenging the Constitutionality of a Law find that the Tried Law is in direct violation of the Constitution of the Democracy of the Free Constituency of Seaview, the Law shall be immediately rendered void and any and all Punishments issued by the voided Law shall be immediately reversed. LAWS OF THE DEMOCRACY OF THE FREE CONSTITUENCY OF SEAVIEW EAM15001: Abolishment of the Tolerance of Malice against the Posted Rules Any vandalism, unapproved alteration, unapproved intentional concealment, unapproved removal, or otherwise defacement of any posted Law of the Democracy of Seaview will be immediately tried. A three-day Notice of Eviction, in accordance with EAM15004, should the accused be found guilty by a Jury of his or her Peers. EAM15002: Imposition of the Prevention of Grieving (Prevention of Grief Act) Should any Citizen, Member, ex-Citizen, or ex-Member of the Democracy of Seaview be accused of breaking or destroying things other than their own personal Property, with the exception of proof of permission, one or more Server Admins and/or one or more Game Admins will be immediately contacted to perform a thorough investigation of the area(s) in question. The user suspected of the malice shall be subjected as the Defendant to a Trial by Jury of his or her Peers. Should the Defendant be found guilty of the aforementioned malice, a Grief Report will be immediately filed and, upon confirmation of malicious damage to property in response to said Grief Report by a Server Admin or Game Admin, the Defendant will be immediately removed from the Democracy of Seaview, so long as the Defendant is a current Citizen of the Democracy of Seaview, and will be barred entry to the Democracy of Seaview by way of an announcement of a Banishment from the Democracy of Seaview only to be issued by the Applicant Mayor. Should the Defendant not be a current Citizen of the Democracy of Seaview, the Defendant will be barred entry to the Democracy of Seaview by way of an announcement of a Banishment from the Democracy of Seaview only to be issued by the Applicant Mayor. Should the Defendant not be barred entry to the Server of EcoCityCraft, assuming the Defendant is a Citizen of the Democracy of Seaview, the Defendant may only be allowed within the Boundaries of the Democracy of Seaview when accompanied by a Super Moderator, Game Admin, or Server Admin to reclaim their personal property. EAM15003: Server Banishment of a Citizen of the Democracy of Seaview (Banishment Act) Should any Citizen of the Democracy of Seaview receive any form of Banishment from the Server of EcoCityCraft, with the exception of the Citizen receiving the Banishment at his or her own request and the exception of a Banishment in response to EP15002, a three-day Notice of Eviction, in accordance with EAM15004, will be issued to the Citizen only to be issued by the Applicant Mayor. If the Citizen is to return to the Server, either due to the Banishment being a temporary Banishment or due to the Citizen successfully appealing to his or her permanent Banishment, the Citizen may reclaim his or her Land for exactly three-quarters of the cost of the Land, but only if the Land is not the Land of another Citizen at that point in time. If the Land is the Land of another Citizen at the point in time of the end of the Banishment of a Banished Citizen, the Citizen will be offered Land of equal or lesser size at three-quarters of the cost of the Land. If no Land is owned by no other Citizen, the Unbanished Citizen will be offered Land of equal or lesser size than their former Land at three-quarters of the cost of the Land as soon as said Land is owned by no other citizen. EAM15004: Eviction due to Reasons Outside the Jurisdiction of EAM15002 Section 1. Should any Citizen of the Democracy of Seaview remain offline as according to "/seen <Citizen's username>" for three or more real-life days, the Citizen shall receive an Eviction in accordance with EAM15004§2. The Citizen's Land will be forfeited to the Democracy of Seaview upon reaching seven days of offline status. However, the Citizen will be able to reclaim all Property, with the exclusion of land property, until exactly four days of his or her forfeiture of Land. Exemptions will only be granted if the Citizen informs the Applicant Mayor of planned offline status prior to remaining offline for seventy-two hours. Section 2. Should a reason for the Eviction of any Citizen of the Democracy of Seaview arise outside the jurisdiction of EAM15002, the Citizen shall be immediately issued a three-day Notice of Eviction only to be issued by the Applicant Mayor. If the Citizen is to remain offline for all three days of the lifespan of the Notice of Eviction, the Eviction will not take place until exactly seven days since the issuance of the Notice of Eviction, in accordance with the Server Rules of EcoCityCraft § 5.3.1.4.
