You are responsible for what happens to your account. If you share an account, the other player will need to know the rules of the server as well. If your brother does do something to break the rules on your account, you are held responsible and your account is banned assuming it's grief (again). Long story short, don't share accounts with your brother if you don't trust him to not break the rules.
