This is a tough scam to prove because the person selling it, has no control over any other player finding and destroying the spawner. Sadly there is no proof the spawn "didn't" exist when he sold it. There is also no proof he intentionally scammed you selling false coordinates either. You probably should have gone with the person, out into the mining world and to the spawner, to verify it existed before paying. RagMan
