Did you ever ask him if it was used? While ignorance is clearly not bliss in this situation, you should have asked him if it was used. Its the responsibility of both parties in a trade to make it clear, and whilst he didn't say it was used you still should of asked. Try talking to him about it and see if you can work something out instead of rushing to a complaint.

Zeno's post as well. It may be frustrating buying something you didn't really think you were paying for, but try to talk to the user first. Communication is a huge component when it comes to any kind of business. Thread is noted, but we can't do anything about it.
