After further examination, it seems that the pickaxe was thrown onto the floor, which means that what happened was fair play. As soon as an object is on the fround, its considerably "fair play" to anyone who wants to take it. To avoid this in the future, use chests, or even mods, to go ahead with transactions and avoid incidences like this. Locked. No rules broken.
