By breaching this contract, over the period of approximately two weeks that it took him to replace the sword, he cost me well over the price of a melon sword. in math: I spent about 5-7 hours a day online during the time that we had the original sword. during this time, I was making around 50k/day with on/off farming. 50k*14 days = 700k total lost profits from not having the sword. Now, as you can see in this complaint, I was fine with him getting a new sword. why? because he was banned. This was not a "buy a sword and re-initiate the contract" deal. it was a "I am willing to let you get unbanned for the payment of a melon sword, despite it being worth only half of what you lost me" I was under the assumption that, now that he had breached and been banned for the contract, the contract was null and void. thus, taking ownership of the melon sword, I sold it and planned to split the profits from this sale with the other contractor (sitomo) once he got unbanned, which at the time he was. If I was mistaken in assuming this, and am to therefore understand that contracts can not ever truly be breached, but rather only punished for temporary breaches, then I will (albeit I will say very unsatisfactorily) be happy to replace the sword again, in the understanding that the contract shall continue again as though nothing has happened. However, if the contract is indeed null and void after that first breach and ban, then my very banning is not legal and I should be unbanned as soon as possible with zero repercussions. Evidence: My word. ADDITIONAL INFORMATION: Have been without internet for near two weeks. Sorry for not participating in the complaint. Could have smoothed things over then instead.
According to that complaint, dwite was never banned for it and the contract was never breached. It looks more like it was resolved with the melon sword being replaced and there's no indication anywhere that the contract was in any way nulled or voided with any party involved. Do you have the sword in your possession?
I do not. As I said, I sold it. He breached someone else's contract and was banned for it. at that time i complained and was denied because he was already banned. he was then unbanned for that contract, so I complained again. been a while, sorry I must have forgotten he was not banned from mine. however, he should (and would) have been from the first complaint had he not already been banned. In addition, the fact remains that he did break the contract and cost myself more money then the sword was worth. I considered the contract null merely because it was broken. I was not aware that contracts persist when broken. if this is true, again, i will be glad to purchase another melon sword and begin the contract again as though no one ever broke it, seeing as in this case they would be unbreakable in truth.
During your complaint after my unbanning, I got the new sword and put it in the chest as you instructed me, no one ever told you that the contract has been breached, but yourself.
False. Even after you agreed to return the sword, it took you over a week (of time where you were not banned despite a breached contract) to get it where I could access it, despite the fact that the pre-determined chest was available to you the entire time. in addition, the contract states that you return it to the chest before logging off. you failed this numerous time, even under the ludicrous assumption that you never lost or sold it in any way.
So after discussing this with rabidworm, I have decided to let him back on the server in order to allow him to resolve this conflict. He will have 7 days (until the end of July 11th) to either replace the melon sword, or, come up with a new agreement with the users in question. He can contact me for any assistance needed in creating new paperwork. Unbanned and locked.
